Em recente julgamento, a Subseção I Especializada em Dissídios Individuais (SDI-1) do TST, órgão responsável por consolidar e uniformizar a jurisprudência trabalhista, decidiu pela possibilidade de ajuizamento de reclamação trabalhista no foro do domicílio do reclamante e não do local de prestação de serviços.
A decisão flexibiliza o que determina o artigo 651 da CLT, segundo o qual, é competente para a vara do trabalho do local onde o empregado prestar serviços ao empregador, ainda que tenha sido contratado em outro local. No caso em julgamento, a autora foi contratada em Altamira (PA) e, após a dispensa, ajuizou a reclamação trabalhista em Uberlândia, local de sua residência.
Tal entendimento pode servir de precedente para outros julgamentos que versarem sobre a competência do local para ajuizamento de reclamação trabalhista.
